Acceptance of Terms

By downloading, installing, or using AbleMind ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and BeachDev LLC ("we," "us," or "our"), a limited liability company.

What AbleMind Is

AbleMind is an iOS application that connects to Ableton Live running on your computer via your local Wi-Fi network. It allows you to control your Ableton Live session, generate MIDI, shape sounds, and manage your session using natural language through a third-party AI provider of your choosing.

AbleMind requires a separately licensed copy of Ableton Live (version 10 or later) and a valid API key from a supported AI provider. These are not included with AbleMind and must be obtained independently.

Subscription & Billing

AbleMind is offered on a subscription basis with the following tiers:

All subscriptions are managed through the Apple App Store and processed by Apple. Payments are charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

To cancel your subscription, go to your iPhone Settings → Apple ID → Subscriptions → AbleMind. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods except where required by applicable law.

Your API Keys (BYOK)

AbleMind uses a bring-your-own-key (BYOK) model. You are responsible for obtaining and maintaining a valid API key from your chosen AI provider and for all costs associated with your API usage.

BeachDev LLC is not responsible for:

Your API key is stored securely in the iOS Keychain on your device and is never transmitted to BeachDev LLC. See our Privacy Policy for full details.

AI Output

AbleMind uses AI to interpret your natural language instructions and generate actions inside Ableton Live, including but not limited to MIDI notes, device parameter changes, track creation, and clip launching.

AI output is inherently variable and unpredictable. We make no guarantees about the musical quality, accuracy, or fitness of any content generated by the AI. You are responsible for reviewing and editing all AI-generated content before use in your projects.

We are not responsible for actions taken by the AI inside your Ableton session, including unintended changes to your project. We recommend saving your Ableton project before using AbleMind, especially for complex or unfamiliar prompts.

Acceptable Use

You agree to use AbleMind only for lawful purposes and in accordance with these Terms. You agree not to:

The AbleMind Bridge (Python Control Surface script) is provided as open source software. Its use is subject to the terms of its open source license as published on GitHub.

Intellectual Property

AbleMind, including its iOS application, design, branding, and proprietary components, is owned by BeachDev LLC and protected by applicable intellectual property laws.

The AbleMind name, logo, and related marks are trademarks of BeachDev LLC. You may not use these marks without prior written permission.

AbleMind is designed to work with Ableton Live. "Ableton" and "Ableton Live" are trademarks of Ableton AG. BeachDev LLC is not affiliated with, endorsed by, or sponsored by Ableton AG.

Disclaimer of Warranties

AbleMind is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the App will function correctly with every version of Ableton Live, every AI provider, or every hardware and software configuration.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, BeachDev LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to your Ableton projects, arising out of or in connection with your use of AbleMind.

In no event shall BeachDev LLC's total liability to you for all claims arising out of or related to these Terms or your use of AbleMind exceed the amount you paid to BeachDev LLC in the twelve months preceding the claim.

Termination

We reserve the right to suspend or terminate your access to AbleMind at any time if we believe you have violated these Terms or if continued access would be harmful to other users or to BeachDev LLC.

You may stop using AbleMind at any time by cancelling your subscription and deleting the app. Cancellation instructions are in the Subscription & Billing section above.

Upon termination, your right to use AbleMind ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which BeachDev LLC is registered, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of AbleMind shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.

Changes to These Terms

We may update these Terms from time to time as the product evolves. When we make material changes, we will update the "Last updated" date at the top of this page and notify users through the app where appropriate.

Your continued use of AbleMind after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using AbleMind and cancel your subscription.
